Request to
File Bankruptcy, Chapter 9
Dear Governor Crist:
I am a property owner within the Stoneybrook Community located in Estero, Florida. The Stoneybrook Community Development District provided the
infrastructure for our community and owns a public golf course that meanders through the community.
On September 3, 2010, the District submitted a request to your office for permission to file
bankruptcy. That request was rejected on
October 4, 2010, stating the reason for the denial as your concern that all alternatives
had not been explored, without offering any suggested alternatives for the District’s consideration.
As a homeowner, I feel my investment is in danger of being extremely adversely affected if the District is not
allowed to seek protection under Chapter 9 of the U.S. Bankruptcy Code. It is clear that the
District must access additional operating capital and restructure the existing golf course revenue debt in order to keep the course
operating. It can only do so if the post-petition financers are granted the protections
provided by the bankruptcy code. If the course is forced to close because additional operating
capital is not secured, there will be significant adverse impacts on our community.
The District will be submitting additional information for your reconsideration of this matter in the near future.
I urge you to take into consideration the urgency of this situation and grant the District’s request to seek bankruptcy protection.
